Curba Terms of Service

1. About Curba
"Curba" is a trade name of 2814447 Alberta Inc., a corporation existing under the laws of Alberta, Canada (the "Operator", "Curba", "we", "us", "our"). The Operator operates an online peer-to-peer rental marketplace (the "Platform") at https://curba.app that allows individuals to list items for rent ("Hosts") and to rent those items ("Renters") within Canada.
By creating an account, listing an item, or sending a rental inquiry, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Platform.
2. The Marketplace Role of Curba
Curba is a technology platform that connects Hosts and Renters. Curba is not a party to any rental agreement between a Host and a Renter.
When a Host accepts a Renter's inquiry and the Renter pays through the Platform, a separate Rental Agreement is formed directly between the Host and the Renter on the terms displayed in the inquiry (item, dates, price, deposit, cancellation policy, and any pickup instructions).
Curba's role is limited to:
- Hosting listings, messaging, and inquiry data
- Processing payments through Stripe Connect (see Section 6)
- Holding refundable security deposits where applicable
- Operating the Curba Insurance program where applicable (see Section 8)
- Providing dispute support tools
Curba does not own, inspect, deliver, or guarantee the condition, quality, safety, legality, or accuracy of any listed item. Hosts and Renters are solely responsible for evaluating each other and the items they exchange.
3. Eligibility
To use Curba you must:
- Be at least 18 years old
- Be a resident of Canada
- Have legal capacity to enter contracts
- Complete identity verification (Stripe Identity) before listing items, completing certain transactions, or withdrawing funds
- Not be barred from receiving services under applicable law
We may refuse, suspend, or terminate any account at our discretion, including if we believe an account has been used for fraud, prohibited items, or violations of these Terms.
4. Accounts and Identity Verification
You are responsible for the security of your account credentials and for all activity under your account. You must provide accurate information and keep it current.
Identity verification is performed by Stripe Identity and may require government-issued ID, a selfie, and address. By submitting verification documents you authorize Stripe to verify the documents on Curba's behalf and to share the result (and verified personal data fields) with Curba. See our Privacy Policy for details on how this data is handled.
5. Listings and Host Obligations
If you list an item, you represent that:
- You own the item or are otherwise legally entitled to rent it
- The item is accurately described, including condition and value
- The item is safe, functional, and lawful to rent
- The item is not on Curba's prohibited items list (firearms, controlled substances, items requiring a licence to operate that the Renter does not hold, etc.)
- You will honour confirmed bookings and provide the item at the agreed pickup time and location
- You will respond to inquiries in a reasonable time
You set your own pricing, rental period, cancellation policy, and pickup terms. Curba may remove listings that violate these Terms or applicable law.
You are responsible for any taxes you owe on income earned through the Platform (other than sales tax that Curba collects and remits - see Section 7).
6. Payments, Fees, and Stripe Connect
Payments are processed by Stripe, Inc. and Stripe Payments Canada, Ltd. ("Stripe"). By using the Platform you agree to the Stripe Connected Account Agreement and the Stripe Services Agreement, as applicable.
6.1 Renter Payments
When a Renter confirms a booking, the Renter authorizes Stripe to charge their payment method for the Total, which includes:
- The rental subtotal
- Applicable taxes (HST/GST/QST/PST as required by the pickup province)
- A platform service fee (the "Renter Service Fee")
- A refundable security deposit, where applicable
The deposit is authorized as a separate hold and is not captured unless a damage or loss claim is approved.
6.2 Host Earnings
Upon successful pickup the Renter's payment is captured. Curba deducts:
- The Renter Service Fee
- A host service fee (the "Host Service Fee")
- Applicable taxes
The remaining balance (the rental subtotal minus the Host Service Fee) is transferred to the Host's connected Stripe account. Hosts may withdraw their balance at any time. Funds may be subject to Stripe's standard settlement timing (typically 1–2 business days for bank payouts, instant for eligible cards).
6.3 Fee Changes
Fees and tax rates are displayed in each booking summary before confirmation and are binding for that booking. Curba may change its fees prospectively with notice on the Platform.
7. Taxes
Curba collects and remits Canadian sales tax (HST/GST/QST/PST) on the rental subtotal at the rate applicable to the pickup province, as required by law.
You are responsible for any other taxes related to your use of the Platform, including income tax on amounts you earn as a Host.
8. Curba Insurance, Protection Tiers, and Deposits
Each listing is assigned a protection tier based on its category. There are two models:
8.1 Curba Insured Listings
For categories marked "Curba Insured", Curba provides limited coverage for accidental damage, theft, or loss occurring during the rental period, up to the maximum claim amount applicable to that tier. The maximum claim amount, deposit percentage, and the categories assigned to each tier are set by Curba and may be updated from time to time. The values in effect at the time of booking are displayed in the booking summary before confirmation and bind that specific rental for the duration of its lifecycle (claim window included), even if Curba updates the program afterwards.
Coverage is subject to:
- Submission of a claim within 48 hours (2 calendar days) of the Host clicking Confirm Return on the rental
- Provision of evidence (photos, police report where applicable, proof of value)
- The Renter being a verified user in good standing
- The damage or loss not being caused by the Host's negligence, normal wear and tear, or excluded events listed below
- Curba's good-faith determination of the claim
For Curba Insured tiers that include a security deposit, the deposit is captured first and applied against the approved claim. Curba then covers the remaining approved amount up to the maximum claim amount for the tier as displayed at booking time. Curba does not charge the Host a separate deductible.
Excluded events include but are not limited to: intentional damage by the Host, pre-existing damage, mechanical breakdown unrelated to the rental, items that were misrepresented in the listing, items used outside the agreed rental period, items used in violation of the listing's stated rules or applicable law, and consequential or indirect losses.
Curba Insured coverage is provided by Curba directly and is not an insurance contract. It is a limited service guarantee subject to these Terms. Curba may modify or end the program with notice.
8.2 Self-Declared Listings
For categories that are not Curba Insured, the Renter signs a Damage Declaration before payment and posts a refundable security deposit. In the event of damage, loss, or late return, the Host may submit a claim to Curba supported by evidence. Curba will mediate in good faith and may release all or part of the deposit to the Host. The Host's recovery from a Self-Declared rental is limited to the security deposit posted. Any losses exceeding the deposit must be pursued by the Host directly against the Renter.
8.3 Limitation
In all cases, Curba's total liability for any single rental - whether under Curba Insured coverage, Self-Declared deposit recovery, or otherwise - is capped at the maximum claim amount for that tier (Curba Insured) or the security deposit amount (Self-Declared) as displayed in the booking summary at the time of booking, whichever applies. Curba is not an insurer and does not provide insurance.
9. Cancellations and Refunds
Each listing displays a cancellation policy (e.g. Flexible, Moderate, Strict). The policy in effect at the time of booking governs the refund. Cancellation fees may apply and are deducted from the Renter's refund per the policy.
Curba may cancel a booking and issue a full refund if it determines the Host or item is not as described, the Host is unresponsive, or the booking violates these Terms or applicable law.
10. Rules of Conduct
You agree not to:
- Use the Platform for any unlawful purpose
- List or rent prohibited items
- Misrepresent yourself, your items, or your insurance status
- Harass, threaten, or discriminate against other users
- Bypass the Platform to transact off-platform after being introduced through Curba
- Scrape, reverse-engineer, or interfere with the Platform's operation
- Submit fraudulent claims, reviews, or chargebacks
Violations may result in account suspension, listing removal, withholding of funds pending investigation, and reporting to law enforcement.
11. Reviews
After a rental, both Host and Renter may submit a review. Reviews must be honest, based on first-hand experience, and free of personal attacks, hate speech, or unrelated content. Curba may remove reviews that violate these Terms.
12. Intellectual Property
Curba and its licensors own all intellectual property in the Platform, including software, branding, and content provided by Curba. You retain rights to content you upload (listing photos, descriptions, messages), but grant Curba a worldwide, royalty-free, sublicensable licence to host, display, reproduce, adapt, and use your content for the purpose of operating, promoting, and improving the Platform.
Promotional and marketing use. This licence includes the right to use your listing content (such as listing photos, titles, and descriptions) to advertise and promote both the Platform and individual listings, including on third-party channels such as social media platforms (for example, Meta / Facebook and Instagram), search engines, and other advertising or partner networks. For these purposes we may resize, crop, or overlay your content with Curba branding. We will not attach to your content any name beyond the first name already shown on your listing, and we will not use your content in a way that falsely implies your endorsement of unrelated products or services. If you do not want your listing content used for promotion outside the Platform, you may opt out at any time by contacting support@curba.app, and we will stop using it for off-platform promotion going forward (this does not affect use necessary to operate the Platform, or copies already published by third parties that are outside our reasonable control to remove).
You represent that you have the right to grant this licence and that your content does not infringe any third party's rights.
13. Disclaimers
To the maximum extent permitted by applicable law:
- The Platform is provided "as is" and "as available"
- Curba makes no warranty as to the conduct, identity, or trustworthiness of any user, the condition or quality of any item, the success of any rental, or the uninterrupted availability of the Platform
- Curba does not guarantee any specific outcome from a rental, claim, or dispute
Note for hosts and renters in Canada: Nothing in these Terms limits any rights you have under non-waivable consumer-protection laws of your province (e.g. Ontario Consumer Protection Act, 2002, Quebec Consumer Protection Act).
14. Limitation of Liability
To the maximum extent permitted by applicable law, Curba's aggregate liability arising out of or related to your use of the Platform is limited to the greater of:
- The total fees you paid to Curba in the 12 months preceding the event giving rise to the claim, or
- CAD $500
Curba is not liable for indirect, incidental, special, consequential, or punitive damages, lost profits, or loss of data, even if advised of the possibility of such damages.
This limitation does not apply to liability that cannot be excluded under applicable law (including, in some provinces, liability for gross negligence, fraud, or personal injury caused by Curba's negligence).
15. Indemnity
You agree to indemnify and hold harmless Curba, its officers, employees, and agents from any claim, damage, or expense (including reasonable legal fees) arising from:
- Your breach of these Terms
- Your use of the Platform
- Any rental you participate in as Host or Renter
- Your violation of any law or third-party right
16. Dispute Resolution and Governing Law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles.
Any dispute arising out of or related to these Terms or the Platform shall be resolved exclusively in the courts of Calgary, Alberta, and you consent to the personal jurisdiction of those courts.
If you reside in Quebec, nothing in this section limits your right to bring proceedings in the Quebec courts as required by Quebec law.
17. Changes to These Terms
We may modify these Terms from time to time. If we make material changes we will give notice (e.g. via email or in-app banner) at least 14 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance.
18. Termination
You may close your account at any time. Curba may suspend or terminate your account, with or without notice, if we believe you have violated these Terms or applicable law, or if continuing to provide the Platform to you would expose Curba to legal or financial risk.
Sections that by their nature should survive termination - including 8 (limited liability), 12 (IP), 13–16 (disclaimers, liability, indemnity, governing law) - survive.

20. Common Provisions
20.1 No Waiver
Curba's failure to assert any right or provision under these Terms shall not constitute a waiver of any such right or provision. No waiver shall be considered a further or continuing waiver of such term or any other term.
20.2 Service Interruption and Discontinuation
To ensure the best possible service level, Curba reserves the right to interrupt the Service for maintenance, system updates, or other changes, informing users appropriately. Within the limits of law, Curba may also decide to suspend or discontinue the Service. If the Service is discontinued, Curba will cooperate with users to enable them to withdraw their funds and personal data, and will respect users' rights as provided by applicable law. The Service may also be unavailable due to events outside Curba's reasonable control (e.g. infrastructure outages, force majeure).
20.3 No Resale
You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Platform or its Service without Curba's express prior written permission.
20.4 Assignment of Contract
Curba may transfer, assign, dispose of by novation, or subcontract any or all of its rights or obligations under these Terms, taking your legitimate interests into account. You may not assign or transfer your rights or obligations under these Terms without Curba's written permission.
20.5 Severability
If any provision of these Terms is held to be invalid or unenforceable under applicable law, the invalidity or unenforceability of that provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect.
20.6 Entire Agreement
These Terms (together with the Privacy Policy and any other documents referenced herein) constitute the entire agreement between you and Curba regarding the Platform and supersede any prior agreements between you and Curba on the same subject.
21. Definitions
The following terms have specific meanings throughout these Terms.
- Curba (or this Application or the Platform) - the rental marketplace and related services operated by 2814447 Alberta Inc. (a trade name of which is "Curba") at https://curba.app.
- Operator (or we, us, our) - 2814447 Alberta Inc., the Alberta corporation operating under the trade name "Curba" and providing the Platform.
- User (or you) - any individual who accesses or uses the Platform, whether as a Host, a Renter, or a visitor.
- Host - a User who lists an item for rent on the Platform.
- Renter - a User who rents an item listed on the Platform.
- Rental Agreement - the separate contract formed directly between a Host and a Renter when an inquiry is accepted and paid, on the terms displayed in the inquiry.
- Service - the rental marketplace and related services provided by Curba as described in these Terms and on the Platform.
- Stripe - Stripe, Inc. and Stripe Payments Canada, Ltd., the payment processors used by the Platform.
- Curba Insured - a protection tier under which Curba provides limited coverage for damage or loss as described in Section 8.
- Self-Declared - a protection tier under which the Renter signs a Damage Declaration and posts a refundable security deposit as described in Section 8.
- Agreement - these Terms together with any other related documents or agreements that form the legally binding relationship between the Owner and the User.
